General terms and conditions of business

Scope
These General Terms and Conditions (GTC) apply to all contracts between Foncar Autoüberführung und Spezialtransporte UG, Küppersteger Straße 2, 51373 Leverkusen (hereinafter "Contractor") and its customers (hereinafter "Client") regarding car transfer by truck and special transport.

Conclusion of contract
The order is placed either by email or telephone and becomes binding upon confirmation by the contractor.

Prices and payment terms

Billing is done by invoice.
For special transports, advance payment may be required.
Unless otherwise agreed, invoices are due within 14 days of receipt without deduction.

Cancellation and empty runs

Cancellation is possible up to one week before the agreed transport date.
If the cancellation occurs later, empty runs will be charged, as already scheduled capacities cannot be allocated elsewhere.

Liability

Liability is within the scope of statutory transport liability.
No liability shall be assumed for damage caused by force majeure or circumstances beyond the control of the contractor (e.g. rockfalls).
In the event of accidents caused by third parties, the opposing insurance company is liable.

Place of jurisdiction
The court in Leverkusen shall have jurisdiction for all disputes arising from this contractual relationship.

Final provisions
Should individual provisions of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
